By using the Site you expressly agree to be bound by these Terms of Use and the Site privacy policy and to follow these Terms of Use and all applicable laws and regulations governing use of the Site. The Company reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, The Company may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.

The Company nor www.whisper-sleep.ae will NOT deal with or provide any services to individuals or companies located in OFAC sanctioned countries in accordance with the law of UAE.

The Laws of the United Arab Emirates shall govern the use of the Site and the Terms of Use, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E. United Arab of Emirates is our country of domicile.

You agree to indemnify and hold the Company, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site, or your breach of the Terms of Use.

By providing materials to the Company, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted the Company an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. The advertisers and/or sponsors that provide these advertisements and sponsorships are solely responsible for insuring that the materials submitted for inclusion on the Site are accurate and comply with all applicable laws. The Company is not responsible for the acts or omissions of any advertiser or sponsor.

The Company controls this Site from the U.A.E. The Company makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

The Company accepts payment by Visa or MasterCard debit and credit cards in AED for its products and services.  All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction.

These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of the Company.

If any provision of the Terms of Use is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect.

Mattress and Pillow Return Policy
The WHISPER™ Original Mattress, Essential Mattress, Prime Mattress, Original Pillow, Essential Pillow and Topper

Make sure you raise a return within 14 days of receipt, subject to the following conditions:

• The product must be returned in its original packaging and in a new, unused and unopened condition.
• Reasons such as comfortability, dissatisfaction, feel or performance, height & mattress specification are not valid for a refund.

This return policy extends only to the original purchaser of any WHISPER™ mattress and/or pillow. This return policy is valid only for the period of time the WHISPER™ mattress and/or pillow are owned by the original purchaser of the WHISPER™ mattress and/or pillow. The “original purchaser,” for the purposes of this return policy, is the first purchaser or household of the WHISPER™ mattress and/or pillow from Deep Sleep Home Furniture Trading LLC or a Deep Sleep Home Furniture Trading LLC authorized retailer.

Mattress Exchange Policy
The WHISPER™ Original Mattress, Essential Mattress, Prime Mattress

Make sure you raise an exchange within 14 days of receipt, subject to the following conditions:

• Exchange is applicable only for standard-size mattresses and valid for one-time exchange only.
• The product must be returned in its original packaging and in a new, unused and unopened condition.

We know you want your Whisper products as soon as possible. We aim to process and deliver your order within 3 business days. After your order is placed we will contact you to confirm your shipping address and preferred time and date of delivery. Our warehouses are located in the UAE, and our driver’s will deliver your products to your door step and help with installation of the same should you request it. We will inform you by email on the day your products are out for delivery.

If more than one item is purchased, than we will group the items into a single delivery depending on availability. If an item is out of stock we will inform you of the same via email and phone to arrange for a delayed delivery or cancellation of your order.

We offer free shipping and free returns on all orders delivered in the UAE.

If you would like to cancel or change your order you may do so by contacting us by email at [email protected] one day prior to your order delivery date. If the product(s) you order were not delivered on the same day you requested you may also contact us by email to initiate a cancellation of your order.

If we send you the wrong product or if the product was defective or if the product was damaged in shipping, than you may contact us by email at [email protected] and we will assist you to either initiate a return of the products or replace the product(s) affected.

CASH ON DELIVERY (COD)
We offer Cash on Delivery (COD) in the UAE.

CREDIT / DEBIT CARDS
We offer online payment by Credit Card / Debit Cards at www.whisper-sleep.ae as a secure method of payment for your convenience through our Payment Gateway Partner, PayFort International FZ LLC. Rest assured, your card number will be protected using industry-leading encryption standards. We accept Master Card, and VISA. If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection. The cardholder must retain a copy of transaction records and Merchant policies and rules.

We also offer Credit Card / Debit Card payment on delivery. We accept Master Card, and VISA.

Payments in Credit Cards will be Charged in AED for UAE Buyers. Multiple transactions may result in multiple postings to the cardholder’s monthly statement.
